About These Terms

Medigroup Health Services ("Medigroup," "we," "us," or "our") operates a virtual care platform that connects patients in Manitoba with licensed physicians. These terms govern your access to and use of the Medigroup Virtual Care platform, including any website, mobile interface, or linked service that references these terms (the "Platform"). Please read them carefully.

By creating an account, joining a virtual queue, or otherwise using the Platform, you confirm that you have read and accept these terms. If you do not accept them, you should not use the Platform.

Emergency Medical Needs

Do not use this Platform for medical emergencies. If you are in a life-threatening situation, call 911 or go to your nearest emergency room immediately.

The Platform is intended for non-urgent virtual care only. It is not designed to respond to acute or emergency medical presentations.

What the Platform Is and What It Isn't

Medigroup provides technology infrastructure that enables patients to connect with licensed physicians for virtual consultations. Medigroup is a technology provider, not a licensed medical practitioner. Medigroup does not provide medical diagnoses, clinical advice, or treatment recommendations.

Any clinical decisions made during a virtual encounter are made by the physician treating you, under their independent professional judgment. Medigroup is not responsible for those decisions.

You are responsible for providing accurate and complete information to your physician and for following any medical advice or recommendations provided. Virtual care is intended to complement, not replace, your relationship with your primary care provider. Nothing you receive through this Platform should be treated as a substitute for ongoing care with a physician who knows your medical history.

Personal Health Information

Personal health information collected in connection with your care is under the custody and control of the physician providing services to you. Medigroup may process such information solely as necessary to operate the Platform and support the provision of care, and does so in accordance with applicable privacy laws and its Privacy Policy.

Scope of Virtual Care

When you use the Platform, you are consenting to receive care through a virtual format. The scope of any given visit, including whether a diagnosis, prescription, or referral is appropriate, is determined entirely by the physician providing care. There is no guarantee of any particular outcome, treatment, or prescription from any virtual encounter.

Your physician may determine at any time that your condition is not appropriate for virtual management and may advise you to seek in-person care.

Informed Consent for Telemedicine

Virtual care involves the use of encrypted audio and video technology to allow a physician to assess and treat patients remotely. Information shared during a visit, including live video, audio, and any documents you submit, may be used to support your diagnosis, treatment, and ongoing care coordination.

Anticipated benefits of virtual care include:

  • Convenient access to a physician without requiring travel to a clinic
  • Faster access to care, particularly for common or uncomplicated presentations
  • More flexible scheduling for both patients and providers

You should also be aware of the following limitations and risks:

  • Technical issues such as connectivity problems or equipment failure may interrupt or delay your visit
  • Internet-based communications carry a residual risk of interception, even when encrypted
  • The virtual format may limit a physician's ability to conduct a complete physical examination
  • Without access to your full medical history, there is a risk of incomplete information affecting clinical decisions

By using the Platform, you acknowledge these risks. Your consent to receive virtual care will be obtained separately as part of the Virtual Care Consent process.

AI-Assisted Transcription

At the start of a virtual visit, your physician may ask whether you consent to the use of an AI-assisted transcription tool to support their documentation. This is always optional. You may accept or decline before the visit begins.

If you consent, audio from your visit may be processed using third-party tools to assist the physician in preparing clinical documentation. Any resulting transcript or notes form part of your clinical record only once reviewed and adopted by the physician. Medigroup processes such information solely to provide the Platform and under the direction of the physician.

All recordings and transcripts are handled in accordance with applicable health privacy legislation and this Privacy Policy.

Charges and Insurance

Many visits are billable to provincial health insurance where your care is eligible and covered. You are responsible for any charges not covered by insurance, including fees for services that fall outside provincial health plan coverage.

Where applicable, you authorize Medigroup to facilitate payment for non-insured portions of your visit. You will be notified before any charge is applied to a payment method on file.

Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account. If you believe your account has been accessed by an unauthorized party, contact Medigroup immediately through medigroup.ca/contact-us.

Acceptable Use

The Platform is provided solely to support patients seeking virtual care. You agree to use it only for that purpose and in compliance with all applicable laws. You may not use the Platform to:

  • Harass, threaten, or impersonate any individual
  • Submit false information or misrepresent your identity
  • Attempt to gain unauthorized access to any account, system, or data
  • Interfere with or disrupt the operation of the Platform or its underlying infrastructure
  • Use the Platform for any commercial or non-personal purpose without prior written authorization

Intellectual Property

All content on the Platform, including text, design, software, and related materials, is owned by Medigroup or its licensors and is protected under applicable Canadian intellectual property laws. You may use the Platform for personal, non-commercial purposes only. You may not reproduce, distribute, or repurpose any Platform content without our express written permission.

Limitation of Liability

To the fullest extent permitted by law, Medigroup and its service providers will not be liable for indirect, incidental, or consequential damages arising from your use of or inability to use the Platform. The Platform is provided on an "as is" basis. Medigroup makes no warranties, express or implied, regarding the suitability, reliability, or accuracy of the Platform for any particular purpose.

Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. Where applicable law requires, our liability will be limited to the minimum extent permitted.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including obligations under applicable privacy legislation.

Governing Law and Jurisdiction

These terms are governed by the laws of the Province of Manitoba, Canada. Any dispute arising out of or relating to your use of the Platform shall be submitted to the jurisdiction of the courts of competent jurisdiction in Winnipeg, Manitoba, unless otherwise required by applicable law.

Changes to These Terms

We may update these terms from time to time. Updated terms will be posted at medigroup.ca or within the Platform, and will take effect upon posting. Continued use of the Platform after any update constitutes acceptance of the revised terms. We encourage you to review these terms periodically. Where required by applicable law, we will provide notice of material changes.
